The 2012 Winter Regional Conference is a continuing judicial education program designed especially for Texas judges by the Texas Center for the Judiciary's Curriculum Committee and funded by a grant from the Texas Court of Criminal Appeals.  For their attendance, participants will earn ten (10) continuing judicial education credits, including up to1.5 ethics credits and 1.0 hour of family violence credit.

Social Media and the Court: Staying within Ethical Boundaries

Many of you have already explored the admissibility and discoverability issues that arise with social media, but what about the ethical issues that arise with your use of a networking site? The line between your personal and public life continues to blur with the use of the Internet and social networking sites. This session will address such questions as: “May I ‘friend’ a lawyer?”; “May a campaign committee establish a page that has an option for persons to list themselves as fans?”; or “Can I research companies or persons in my court using Google?” Although Texas does not currently have any ethics opinions concerning the boundaries for a judge's use of social media, Judge Sue Kurita, Commissioner on the State Commission on Judicial Conduct, and Judge Paul Davis, Chair of the Ethics Committee of the Judicial Section of the State Bar of Texas, will discuss the opinions that have been issued in other states and the potential impact on you and your policies.

These Court Interpreters...Who Do They Think They Are?

This session will provide the opportunity for a frank exchange of ideas and perspectives regarding the role of court interpreters, from the Court's and the interpreter's points of view. Materials provided by the National Center for State Courts and TRIP (Texas Remote Interpreter Project) will be used to foster the exchange of ideas. Some of the topics to be discussed include: What is the goal of having an interpreter? How does one qualify an interpreter? What are certified and/or licensed interpreters? What does the Texas Code of Ethics and Professional Responsibilities for Licensed Interpreters (Tex. Administrative Code § 80.100) prohibit an interpreter from doing? This session will also include the applicability of the Texas Rules of Evidence 10.09 to the use of interpreters and an overview the TRIP program, its requirements, and funding.

Each of the panelists for this session will present their perspectives on the intersection among the three substantive areas of law and the jurisdictional disputes and challenges that flow from the tension created when these areas of law overlap.

Closely Held Companies: Emerging Issues with Litigation

Suits involving disputes in closely held corporations and limited liability companies increasingly include claims of “oppression” against those in control of the company. The challenges faced by judges in these cases include the uncertain parameters of the developing “oppression” doctrine and issues raised by relatively recent statutory changes. Professor Douglas Moll, University of Houston Law Center, and Professor Elizabeth Miller, Baylor Law School, will provide an overview of the existing Texas case law addressing oppression claims and will discuss some of the difficult issues raised by the doctrine.

Child Witnesses in the Courtroom

Child Witnesses in the Courtroom

Ms. Joy Rauls, Executive Director for the Children’s Advocacy Centers of Texas, with Mr. Dan Powers from the Collin County Children’s Advocacy Center, will address the case law and recent statutory changes surrounding appropriate accommodations for judicial consideration when working with children in the courtroom as witness or victims. Over the years, children have increasingly played a larger role in the justice system as witnesses in criminal and civil suits. Modifications have been successfully implemented across the state, many of which have received support under Texas statute and case law. Ms. Rauls will also introduce you to a bench aid for handling child witnesses in the courtroom that was circulated to TCJ’s mailing list in the fall. This product was created through a partnership with the Texas Supreme Court Permanent Judicial Commission on Children, Youth and Families, The Children’s Justice Act Taskforce, and the Texas Center for the Judiciary.

Saluté! Join us on our Texas gondolas for an adventure into the world of Texas wines...an educational and fun-filled tasting that includes cruising the canals of the famous Riverwalk. A professional wine connoisseur will guide you through the labyrinth of vintages and techniques employed by the various wine makers throughout the State of Texas. We begin with a stroll along the scenic streets of San Antonio, through historic plazas, over footbridges and then river level, and make our way along the lushly landscaped banks. Guests enter a private wine tasting room hidden underneath the Aztec Theater. Our local cork dork will walk you through a hand-picked selection of wines which are reflective of the variety of grapes and methods which are practiced in the Lone Star State. Then experience the ambience of the river while toasting with the talents of our inspired winemakers! Reimbursements

Introduction

This program is funded by a grant from the Court of Criminal Appeals and is thereby governed by the reimbursement policies of both the Court and the Texas Center for the Judiciary. All travel expenses will be paid in accordance with the following policies. Reimbursements for personal expenses and tips are not allowed. 

Due DateAll reimbursement claims must be submitted within 60 days of the event. The deadline for submitting reimbursement forms for this program is April 22, 2012. Please allow 30 days (from the date we receive your form) for processing.
Receipts

Receipts are required for lodging, taxi, parking, shuttle service, and airline tickets (receipts for meals are not required for reimbursement). Third-party Internet booking receipts, such as Expedia and Travelocity, are not valid receipts and therefore will not be reimbursed. Internet booking receipts direct from the service provider (e.g., Southwest Airlines, Hilton Hotels) are valid and will be reimbursed.

Parking

Complimentary self-parking is available at the Hyatt Regency Hill Country. Valet parking is not reimbursable unless special assistance is required. Airport parking receipts are required for reimbursement. 

Transportation

The Texas Center will reimburse your travel expenses in accordance with the Court of Criminal Appeals guidelines, e.g. economy airfare or 45 cents per mile for travel by personal automobile. Rental cars must be approved in advance to be eligible for reimbursement.

Mileage Calculation

Supporting documentation for mileage must include a printout from a mapping website (e.g. Google Maps, MapQuest). In determining mileage you may choose the most cost-effective, reasonably safe, shortest route, the quickest drive time or the safest road conditions between destination points. The printout must be attached to your reimbursement and sufficiently detailed to verify the number of miles. Note: Mileage may not be calculated using only a vehicle odometer reading.

Meals

The Texas Center will reimburse for the actual cost of non-contracted meals up to a maximum of $36 per day. 

Lodging

The single occupancy rate of $114 plus applicable taxes for your hotel room will be reimbursed by the Texas Center for arrival on Sunday, February 19 and departure on Tuesday, February 21. Additional room nights, guests, and incidentals are not reimbursable. Please remember District and Appellate Judges are exempt from hotel occupancy tax. County Court at Law Judges are not exempt from hotel taxes.

SATrans is the official shuttle service from the San Antonio International Airport to the Hyatt Regency Hill Country Resort and Spa. Shuttle departs daily from 7am-1am. Shuttle tickets are sold at the baggage claim area, at Terminal 1 and Terminal 2. Please tell the ticket agent that you are attending the Winter Regional Conference of the Texas Center for the Judiciary to receive a discount on the $60 round trip fare.

Take 410 West and follow it as it turns into 410 South. Exit onto Hwy 151 West/Sea World (Exit 9A.) Continue on 151 West for about 2.5 miles, take the Westover Hills Blvd Exit, and take your first available right (at the windmill) onto Hyatt Resort Dr. and continue straight. If you have missed the Hyatt Resort Dr. turn, go to the stop light ahead at Westover Hills Blvd., turn right onto Westover Hills Blvd and then take your first immediate right onto Rogers Rd. From the North

From I-35 South, take 410 West for approx 25 minutes. 410 West will turn into 410 South. Exit onto Hwy 151 West/Sea World (Exit 9A.) Continue on 151 West for about 2.5 miles, take the Westover Hills Blvd Exit, and take your first available right (at the windmill) onto Hyatt Resort Dr. and continue straight. Participants may request refunds for conference registration and optional activities (e.g. a guest excursion) fees up to seven days prior to a conference to receive a full refund.

Cancellations will not be accepted over the phone. You must submit your cancellation in writing by mailing or faxing a copy of the cancellation form. Please allow 30 days to process the refund request.
