Commercial motor vehicles, especially large trucks, have a significant impact on traffic safety. Crashes involving such vehicles have a greater potential to be devastating than those involving only passenger cars. As such, state and federal legislators have adopted heightened standards for Commercial Driver’s License (CDL) holders charged with impaired driving and other traffic offenses. Because the intersection of Texas and federal law in this area is complex, confusion and misconceptions often arise when Texas judges handle these cases. This course will cover the public policy considerations leading to heightened legal standards for CDL holders, describe those standards (both state and federal), and give participants guidance on avoiding the legal and ethical pitfalls related to “CDL masking.”
